🚫 Free Non-Riding Licence Doesn’t Make You a Voting Member

Brad Bellette • 16 June 2025

🚫 Why a Free Non-Riding Licence Doesn’t Make You a Voting Member

This is a common question, and it's an important one.

While a free Non-Riding membership with AusCycling may let you appear in the club system, it does not make you a financial member under our Constitution and therefore, you do not qualify as a Voting Member.

❗ Here’s why:

🟨 1. Clause 6.3 – Becoming a Member Requires Payment

“A person becomes a Member of the Club when the Club has accepted the person’s application and the person undertakes to:
(b) pay the fees and subscriptions determined to apply to the Member under clause 11.”

🟒 If no fee has been paid (as with the free Non-Riding option), this requirement is not met.

🟨 2. Clause 6.2(a) – Only Individual Members Can Vote

“Individual Members, who subject to this Constitution shall have the right to receive notice of, attend and vote at General Meetings...”

🟒 An Individual Member must first be properly admitted under Clause 6.3, which includes the requirement to pay a fee.

🟨 3. Clause 11.2 – Voting Rights Are Suspended if Fees Are Not Paid

“The right of a Member to attend and vote at a General Meeting is suspended while the payment of any subscription or other amount... is in arrears greater than 60 days.”

πŸ›‘ If the member never paid in the first place (i.e. holds a free membership), they are never considered financial meaning they were never eligible to vote.

βœ… So What Counts as a Voting Membership?

You must hold a paid and current AusCycling membership (e.g. Lifestyle, Race, Volunteer – if paid),
and be:

  • 18 years or older
  • Linked to Red Centre BMX as your primary club
  • Financial meaning a fee has been paid

If you're on a free non-riding licence, your name might appear in club reports, but you don’t meet the criteria of a financial Individual Member under the Constitution.

🧠 Bottom Line

Being in the AusCycling system doesn’t automatically mean you’re a member of Red Centre BMX with voting rights.

A free Non-Riding membership is not sufficient. You must have paid a recognised membership fee to be considered a Voting Member under our rules.
